Candidate drags SDP, INEC to court in Delta


The Social Democratic Party’s House of Representatives candidate for Warri Federal Constituency in Delta State, Chief Monday Keme, has asked a Federal High Court sitting in Warri to compel his party to submit his name to the Independent National Electoral Commission.



Keme, in a suit marked FHC/WR/CS/119/2018, is also praying the court to grant an order of perpetual injunction restraining INEC from accepting or recognising any other name apart from his own as the candidate of the party for Warri Federal Constituency.



The plaintiff, who had earlier raised the alarm over an alleged plot to substitute his name with Reyenieju Daniel, who currently represents the area on the platform of the Peoples Democratic Party, said he remained the party’s validly nominated candidate.



The case, which has SDP and INEC as the first and second defendants respectively, has been slated for January 22, 2019 for hearing.



The writ of summons filed by Keme’s counsel, U.K. Gbenebitse, of T.C. Williams & Co., asked the defendants to respond to the summons by causing an appearance to be entered in the suit.



A copy of the suit we obtained on Wednesday showed that he is seeking, “A declaration that the plaintiff is the validly nominated candidate for the 1st defendant’s ticket for Warri Federal Constituency into the House of Representatives in the 2019 general elections.



 “An order compelling the 1st defendant to submit the name of the plaintiff to the 2nd defendant as the candidate of the 1st defendant for the 2019 general elections of the Warri Federal Constituency into the House of Representatives.”



 “An order of perpetual injunction restraining the 1st defendant from submitting any other name/candidate to the 2nd defendant as the candidate of the 1st defendant for the 2019 general elections for Warri Federal Constituency into the House of Representatives.



 “An order of perpetual injunction restraining the 2nd defendant from accepting/recognising any other name/candidate of the 1st defendant from the 1st defendant for the Warri Federal Constituency into the House of Representatives.”
